JUSTICE SUDHIR SINGH ORAL ORDER 06-12-2016 Heard learned counsel for the petitioners and the State. The petitioners seek bail in a case instituted under Section 401 of the Indian Penal Code.
Allegation against petitioners is that they were apprehended at railway platform while they were trying to flee away seeing police personnel. It is alleged that they used to pickpocket in train.
It has been submitted on behalf of petitioners that he is in custody since 7.10.2016. Chargesheet has been submitted against petitioners. They have got no criminal antecedent. No allegation of tampering of witnesses is alleged against petitioners. They have been made accused due to mistake of fact. No offence under Section 401 of the Indian Penal Code is made out. From the pockets of petitioners Rs.720 and Rs.1850 respectively are said to have been recovered. No other incriminating article is said to have been recovered.
Patna High Court Cr.Misc. No.52006 of 2016 (2) dt.06-12-2016 2/2 On behalf of the State, it is submitted that petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the above named petitioners be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Railway Court, Gaya, in connection with Gaya Rail P.S. Case no. 290 of 2016.
