Petitioner seeks bail in a case registered under Sections 385, 387, 504/34 of Indian Penal Code. It is submitted on behalf of the petitioner that the allegation against the petitioner and other persons, who are family members, is of extortion of money from the informant to allow her to make construction on her land. It is further submitted that in fact the case has been lodged against the petitioner falsely implicating him, as earlier, on the basis of power of attorney executed by one Manjula Mahaseth, he had executed a sale deed in the year, 2007. Subsequently, Manjula Mahaseth executed a registered sale deed in respect of the same land in favour of the

Patna High Court Cr.Misc. No.33292 of 2017 (2) dt.20-07-2017 2/2 informant on 02.05.2014. As a result thereof, in order to pressurize the petitioner and his family members to part with the said land in respect of which power of attorney was executed seven years earlier, he has been implicated in this case. The other co-accused persons, with similar allegation, have already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 12.07.2017 passed in Cr Misc No 25304 of 2017. The petitioner is in custody since 15.05.2017.

In the light of the aforesaid submissions, prayer for bail of the petitioner is allowed. Let the petitioner above named be released on bail on his furnishing bonds of Rs 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Darbhanga in Laheriasarai Police Station Case No 85 of 2017.
