In this case, the petitioner is seeking anticipatory bail in connection with Excise Case No.131 of 2018 registered for the offence punishable under Section 30 (a) (d) of Bihar Prohibition & Excise Act.

The police on information has raided a maize field and recovered 20 litres of country made liquor along with other materials, however, counsel for the petitioner submits that he has no concerned with the recovered liquor and the alleged maize field does not belong to the petitioner. He has further submitted that the co-accused Bam Bam Ram has already been granted anticipatory bail by a coordinate Bench of this Court

Patna High Court CR. MISC. No.42133 of 2019(2) dt.09-07-2019 2/2 vide order dated 07.05.2019 passed in Cr. Misc. No.29892 of 2019 (Annexure-2).

Looking to the entire facts and circumstances of the case, let the petitioner, above-named, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the 2nd Additional District and Sessions Judge, Sheikhpura in connection with Excise Case No.131 of 2018 subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure with a further condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
