2. The petitioner has prayed for regular bail in a case registered for the offence punishable under Sections 341, 323, 324, 326, 307 and 120(B) of the Indian Penal Code and under Section 27 of the Arms Act.
3. The case of the prosecution is that the petitioner along with others have made indiscriminate firing on the informant due to which he has received 3 gunshot injuries in his leg and waist.
4. Learned counsel for the petitioner has submitted that from perusal of the FIR itself it is clear that there are four accused persons, two are named and two are not named and the
Patna High Court CR. MISC. No.42152 of 2025(3) dt.20-08-2025 2/2 nature of allegation is general and omnibus. It has also been submitted by the learned counsel for the petitioner that vide Annexure-P/3 parties have compromised the case. From perusal of the injury report it is clear that though the informant has received gunshot injuries, the nature of injury is simple.
5. Learned APP for the State has vehemently opposed the bail.
6. Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail in connection with Samastipur Muffasil P.S. Case No. 230 of 2020 on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Samastipur.
