ANJANA MISHRA ORAL ORDER 17-08-2015 Heard learned counsel for the petitioners and the learned counsel for the State.
The petitioners are apprehending their arrest in connection with Baisi P.S. Case No.86 of 2015 for allegedly having committed the offences under Sections 341, 323 and 307/34 of the Indian Penal Code.
Learned counsel for the petitioners submits that the present case has been lodged against these petitioners and though they have been named, there is no specific allegation against them. It is further submitted that the main allegation is against one Md. Washique and Md. Mohsin @ Md. Mosijm (petitioner No.4). So
Patna High Court Cr.Misc. No.32278 of 2015 (2) dt.17-08-2015 2/2 far as others petitioners are concerned, the allegation is not specific.
Considering the aforementioned facts and circumstances, let petitioner Nos.1, 2, 3 and 5, above named, in the event of their arrest or surrender before the court below within a period of three weeks from the date of receipt/production of a copy of this order, be released on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of Sri Ranvijay Kumar, learned Judicial Magistrate, 1st Class, Purnea, in connection with Baisi P.S. Case No.86 of 2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. However, so far as prayer for bail made on behalf of Petitioner No.4-Md. Mohsin @ Md. Mosim is concerned, the same stands rejected.
