JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 07-07-2021 As prayed for, through Video Conferencing, let the learned counsel for the petitioner remove the defect(s), as pointed out by the office vide its notes dated 21.12.2020, within four weeks of starting of the Court proceeding in physical mode in normal course. Heard learned counsel for the petitioner and the learned A.P.P. for the State, through Video Conferencing. The petitioner apprehends her arrest in connection with Bettiah Mahila P.S. Case No.14 of 2020 registered under Sections 341, 323, 498A, 506 and 497 of the Indian Penal Code. The accusation is that the marriage of the informant Soni Devi was performed with Kuldeep Srivastava, son of Late Braj Kishore Srivastava, of village-Siyarahi, Post-Gokhula, P.S. Shikarpur, District-West Champaran, but, later on, Kuldeep Srivastava, the husband of the informant, started to make demand of

Patna High Court CR. MISC. No.37882 of 2020(2) dt.07-07-2021 2/2 Rs.10 lacs in dowry. In the meantime, the informant was blessed with two children but, in spite of that, she was being tortured. Before, one month, Kuldeep Srivastava, the husband of the informant, under conspiracy of his family members, performed the marriage with another girl, namely, Kiran Kumari (petitioner). Learned counsel for the petitioner submits that the petitioner is the second wife of Kuldeep Srivastava, the husband of the informant. At the time of her marriage, Kuldeep Srivastava, had not disclosed about his marriage to the petitioner. The petitioner has falsely been implicated in this case.

Having considered the facts and the circumstances of the case, let the petitioner, above named, in the event of her arrest or surrender by her within six weeks from today, be enlarged on bail on her furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VI, Bettiah, West Champaran, in connection with Bettiah Mahila P.S. Case No.14 of 2020, subject to the conditions laid down under Section 438(2) Cr.P.C. (Rajendra Kumar Mishra, J) P.S./- U T
