This application is filed for grant of regular bail in connection with Barahiya (Lakhisarai) P.S. Case No. 11 C2/2023 registered under section 37 of the Bihar Prohibition and Excise Act, 2018.

Learned counsel for the petitioner submits that petitioner is said to be in custody for consuming liquor. He is in custody since 18.05.2023.

Learned A.P.P. has vehemently opposed the prayer for bail.

Patna High Court CR. MISC. No.41279 of 2023(2) dt.19-07-2023 2/2 Considering the period of custody, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned A.D.J-V in connection with Barahiya (Lakhisarai) P.S. Case No. 11C2/2023.

The Special Judge, Lakhisarai should have granted bail to the petitioner even if the petitioner had a similar antecedent. This case should not have travelled to Hon'ble High Court.
