2. The petitioner seeks bail in connection with Amarpur P.S. Case No. 135 of 2024 registered for the offence punishable under Sections 379 of the Indian Penal Code and Sections 11/41/56(2) of the Bihar Minerals (Concession, Prevention of Illegal Mining, Transportation & Storage) rule, 2019 and Section 4(1)/21 of the Mines and Minerals (Development and Regulation) Act, 1957.
3. The petitioner is alleged to have been involved in illegal mining. He is in jail since 19.03.2024.
4. Learned APP appearing for the State opposes the prayer for regular bail of the petitioner.
5. Considering the aforesaid facts and circumstances
Patna High Court CR. MISC. No.43836 of 2024(2) dt.26-06-2024 2/2 of the case and submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Banka in connection with Amarpur P.S. Case No. 135 of 2024.
6. The petitioner will also mark attendance in Amarpur Police Station on the first Sunday of each month. Any default in appearance at the Police Station would be result in cancellation of bail bonds of the petitioner. (Sandeep Kumar, J) P. Kumar U T
