This is a petition for restoration of Cr. Appeal (SJ) No. 1036 of 2011 to its original file, which has been dismissed for non-compliance of the order dated 19.09.2013 by which the requisites of notice was to be filed within a week, however, it has not been filed within time due to inadvertence. It has been submitted by the learned counsel for the appellant that there is delay of only one day in complying the aforesaid order.

Hence, the delay in complying with the order dated 19.09.2013 is condoned and the appeal is restored to its original file and number. The requisites filed for issuance of notice is accepted. Let the notice be issued.
