Petitioner prays for bail in connection with Patepur P.S.Case No. 15 of 2005 registered for the offences punishable under Sections 420, 467 and 468 of the Indian Penal Code. Petitioner was earlier granted privilege of anticipatory bail by the then co-ordinate Bench of this Court. However, later on anticipatory bail was cancelled vide order dated 23.10.2008 in Cr.Misc.No. 10531 of 2007 on the ground that Dy.S.P. in his supervision note found involvement of the4 petitioner and petitioner has now moved for bail as allegation against the petitioner is that he has sent insured parcel in the name of fictitious company.

Submission of learned counsel for the petitioner is that departmental proceeding was made against the petitioner and

No.48339 of 2018 (3) dt.03-10-2018 2/2 allegation against the petitioner was found false and material shows that except supervision note there is nothing against the petitioner and he is in custody since 7.3.2018 and co-accused having similar allegation has been granted bail vide order dated 29.3.2010 passed in Cr.Misc.No. 9649 of 2010. Heard learned APP also.

Having heard both sides and in the facts and circumstances, let the petitioner, named above, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-X, Vaishali at Hajipur, in connection with Patepur P.S.Case No. 15 of 2005, subject to the condition that one of the bailors shall be a local person having sufficient immoveable properties within the jurisdiction of court concerned and further condition is that petitioner has to co-operate in disposal of trial and appear before the court as and when required, otherwise his bail bond shall be cancelled.
