The petitioner has been in custody since 07.05.2019 in connection with Baheri P.S. Case No. 84/2019 registered for the offence punishable under Sections 30(a) of the Bihar Prohibition and Excise Act.

Learned counsel for the petitioner submits that the recovery has been made from the Mandir and not from the conscious possession of the petitioner and his name has surfaced on the basis of confession.

In view of the aforementioned facts and circumstances and the petitioner has got no criminal antecedent, let the petitioner above named be released on bail, on furnishing bail bonds of Rs.10,000/- (Ten Thousand) with two sureties of
