====================================================== CORAM: HONOURABLE MR. JUSTICE PARTHA SARTHY ORAL ORDER 23-03-2021 Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.
The petitioner has filed the instant application for grant of regular bail in connection with Naubatpur P.S. Case no. 67 of 2020 registered under sections 363 and 366A of the Indian Penal Code.
As per allegation in the first information report, it is stated by the informant that his 15 years old minor daughter went to school but did not return back. It is further stated that his covillager Devendra Paswan was regularly in touch with her on mobile phone and as such he is convinced that the said Devendra Paswan, Lalita Devi and Santosh Kumar have a hand in her disappearance.
It is submitted by learned counsel for the petitioner that the petitioner has no role in disappearance of the informant's
Patna High Court CR. MISC. No.37513 of 2020(5) dt.23-03-2021 2/2 daughter. There is an unexplained delay of three days in lodging of the first information report. It is further submitted that the daughter of the informant returned back and her statement was recorded under section 164 Cr.P.C. wherein she has disclosed herself to be a major and has further stated that she had gone to marry one Subodh. No allegations have been levelled against the petitioner herein. The petitioner is in custody since 3.3.2020 and chargehseet has been submitted in the case..
The application for bail is opposed by learned Additional Public Prosecutor for the State.
Having heard learned counsel for the parties and taking into consideration the submissions made on behalf of the petitioner together with the petitioner being in custody since 3.3.2020, the Court is inclined to enlarge the petitioner on bail. The petitioner is directed to be enlarged on bail in connection with Naubatpur P.S. Case no. 67 of 2020 on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional Chief Judicial Magistrate II, Danapur, Patna.
