ANJANA MISHRA ORAL ORDER 01-12-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. The petitioners are apprehending their arrest in Akbalpur P.S. Case No. 53 of 2015 for the offences under Sections 147, 148, 149, 341, 323, 307 of the Indian Penal Code and 27 of the Arms Act.

The case diary in the present case which was called for has since been received.

Learned counsel for the petitioners submits that general and omnibus allegation has been made against the petitioners whereas other co-accused persons having variously armed with deadly weapons such as iron rod, iron khanti and lathi have assaulted one Ramswaroop Yadav, Hawaldar causing

Patna High Court Cr.Misc. No.33779 of 2015 (4) dt.01-12-2015 2/2 multiple injuries. The injury report which shows that though the same is grievous, the same cannot be attributed to one person as many persons assaulted the deceased.

Considering the nature of allegation and there being no further cogent material in the case diary so as to substantiate the aforesaid factum of assault as also the petitioners have no criminal antecedent, let the petitioners, above named, in the event of their arrest or surrender before the court below within four weeks from today be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of C.J.M., Nawada, in Akbarpur P.S. Case No.53/15 subject to the conditions as laid down under Section 438(2) Cr.P.C. (Anjana Mishra, J) AnilKrSinha/- U
