The petitioner seeks regular bail in connection with Moffasil P.S. Case No.56 of 2018 registered for offences punishable under Sections 401 and 411 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act. Allegation against the petitioner is recovery of one pistol and it appears that petitioner is an accused in three other cases also.

Submission of the learned counsel for the petitioner is that he has falsely been implicated in this case and he is remained in custody for seven months.

Heard learned A.P.P. also.

Having heard both sides and in view of the facts and

Patna High Court Cr.Misc. No.43285 of 2018 (3) dt.07-09-2018 2/2 circumstances, as stated above, I am not inclined to grant bail to the petitioner, however, once the charge has been framed in the case, the petitioner shall be released on bail by the learned trial Court itself on his satisfaction.
