The petitioner is languishing in custody since 21.08.2015 in a case registered for the offence under Sections 304(B) and 201/34 of the IPC.
The prosecution story, in brief, is that the informant's sister, namely, Suganti Devi, was married with this petitioner five years ago. After the marriage, the accused persons including the petitioner started torturing and assaulting his sister due to nonfulfillment of dowry and ultimately they committed her murder and disappeared her dead body.
Earlier the bail application of the petitioner was rejected vide Cr. Misc. No. 30971 of 2016 dated 14.09.2016
Patna High Court Cr.Misc. No.28489 of 2017 (3) dt.20-09-2017 2/2 taking into account that the petitioner is the husband of the deceased. The onus is on him to explain cause of death of the deceased.
A report was called for from the court below regarding the stage of the case. It has been reported that the case is running for appearance and due to non-appearance of accused persons, case has not yet been committed.
Considering the aforesaid facts and circumstances, I am not inclined to grant bail to the petitioner. The same is rejected in connection with Amnour P.S. Case No. 81 of 2015, pending in the court of learned A.C.J.M V, Saran at Chapra. The court below is directed to take all necessary steps to conclude the trial at the earliest.
