The petitioner is in custody in a case registered for the offence punishable under Sections 25(1-b)A, 26 and 35 of the Arms Act.

Prosecution case is that one country made rifle, ten live cartridges and two mobile phones were recovered from the possession of the petitioner.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. He further submits that co-accused Balyogi Kumar @ Tanika has been granted regular bail by a Co-ordinate Bench of this Court passed in Cr. Misc. No. 47600 of 2022 and the case of the petitioner is also better footing. Petitioner is in judicial custody

Learned APP appearing for the State has opposed the prayer for regular bail.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri Vikash Kumar, Judicial Magistrate, Ist Class-cum-Additional Munsif, Begusarai/concerned Court in connection with Matihani P.S. Case No. 19 of 2022.
