JUSTICE DINESH KUMAR SINGH ORAL ORDER 11-01-2016 Though, he matter has been listed under the heading "For Orders (On Office Notes) due to non-appearance of opposite party no.2 but since both the parties have entered their appearance, the matter is being taken up on merits.
Heard learned counsels for the petitioner and the State. The petitioner being the husband of the informant is apprehending arrest in a case registered for the offences punishable under Sections 498A, 379, 341, 323 and 506/34 of the Indian Penal Code and 3/4 of the Dowry Prohibition Act. The basic accusation is of torture for non-fulfillment of dowry demand.
In pursuance to order dated 26.08.2015, the petitioner and the informant are present in the Court.
It is submitted by learned counsel for the petitioner that
Patna High Court Cr.Misc. No.33307 of 2015 (3) dt.11-01-2016 2/2 both sides have resolved the dispute and had filed a petition to that effect before the learned Court below.
The contention of learned counsel for the petitioner has not been controverted by learned counsel representing the informant opposite party no.2.
Considering the present stand of the parties, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Buxarin connection with Dhansoin P.S. Case No.50/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
