Petitioner seeks bail in connection with Barachatty P.S. Case No. 356 of 2016 registered under Sections- 272, 273, 120B of the Indian Penal Code and section 47(a), 48(2), 54, 63 of Bihar Excise (Amendment) Act, 2016.

Recovery of illegal wine was made from the car in which petitioner was also sitting.

Learned counsel for the petitioner submits that petitioner was neither the owner nor the driver of the vehicle from which recovery has been made. It is submitted that petitioner is also a driver and had went to Jharkhand in search of job, but in course of return he met with Rahul Kumar and

Patna High Court Cr.Misc. No.54008 of 2016 (2) dt.16-12-2016 boarded on the car.

Considering the facts and circumstances of the case, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sherghati, Gaya in connection with Barachatty P.S. Case No. 356 of 2016.
