JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 06-07-2017 Heard Sri. Pramod Kumar Singh, learned counsel for the petitioner. No one appears for the State. The petitioner, in the present case, is seeking regular bail in connection with Samastipur (M) P.S. Case No. 155 of 2017 registered under Sections 400, 420, 414, 465, 467, 468, 469, 474 and 120(B)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that from the First Information Report it would appear that the accused persons had assembled with an intention to commit a crime and on chase, police arrested three persons including the present petitioner. Learned counsel refer the seizure list and submits that it is not in accordance with law, as there is no signature of the petitioner on

He would also submit that the allegation is that of seizure of three mobiles with SIM and one TVS Apachhi white colour motorcycle. He would also submit that the motorcycle belongs to the present petitioner. About another motorcycle, the petitioner denied the allegation.

Learned counsel for the petitioner further submits that the petitioner has got one more case under Section 25(1-b)A 26/35 of the Arms Act in which he is on bail. In the present case, he is in custody since 25.03.2017.

Considering the nature of the allegation, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned A.C.J.MVth Samastipur in connection with Samastipur (M) P.S. Case No. 155 of 2017 Subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
