JUSTICE SATYAVRAT VERMA ORAL ORDER 03-02-2022 Heard the learned counsel for the petitioner and the learned APP for the State, through Video Conferencing. The petitioner seeks bail in connection with Chausa P.S. Case No. 46 of 2021, instituted for the offences under Section 25(1-b)a, 26, 35 of Arms Act.

The learned counsel for the petitioner submits that the petitioner is in custody since 09.05.2021, he is a person with clean antecedent, charge-sheet has been submitted in this case and the informant alleges that from Anil Singh, one loaded countrymade pistol and seven live cartridge was recovered. The learned counsel for the petitioner submits that the petitioner is not named in the FIR, as such, was not arrested from the spot and his name came in the confessional statement of Anil Singh which has no evidentiary value.

Considering the fact that petitioner is in custody since 09.05.2021, he is a person with clean antecedent, charge-sheet has been submitted in this case and the name of the petitioner transpired in the confessional statement of co-accused, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned S.D.J.M., Udakishunganj, Madhepura, in connection with Chausa P.S. Case No. 46 of 2021 The application stands allowed.
