Petitioners seek bail in Sonbarsa P.S. Case No.102 of 2019 instituted for the offence under Section(s) 272, 273, 414 Indian Penal Code and Sections 30(a) of Bihar Prohibition and Excise Act, 2016.

It is alleged that on seeing the police party two persons fled away after leaving the motorcycle. The police chased and arrested those persons, who are petitioners. It is alleged that 262.5 litres Nepali liquor has been recovered. Counsel for the petitioner submits that petitioners have been made accused merely on suspicion. There is no recovery from their conscious possession.

In the facts and circumstances of the case, prayer of the petitioners for grant of bail is allowed. Let the petitioners, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the ADJ II cum Special Judge, Excise Act, Sitamarhi, in connection with Sonbarsa P.S.
