JUSTICE SUDHIR SINGH ORAL ORDER 24-11-2016 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case instituted under Sections 406, 420 and 120B of the Indian Penal Code. Allegation is that an agreement was made to sell Scorpio vehicle of the petitioner to informant with an consideration amount of Rs.1,75,000/-. Total money was paid but neither no objection certificate nor owner book was given to informant. It has been submitted on behalf of petitioner that he has got no criminal antecedent. He is in custody since 13.9.2016. Chargesheet has been submitted against petitioner. No allegation of tampering of witnesses is alleged against petitioner. Petitioner has falsely been implicated in the present case. From perusal of F.I.R itself it is evident that no wrongful loss or any wrongful gain has been made by the petitioner. The main allegation is against co-accused Pappu Kumar.

On behalf of the State, it is submitted that petitioner is named in the F.I.R.

Considering the aforesaid facts and circumstances, let the above named petitioner be released on bail on furnishing bail bond

Patna High Court Cr.Misc. No.50500 of 2016 (2) dt.24-11-2016 2/2 of Rs. 10,000/- (Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate,Ist Class, Lakhisarai, in connection with Halsi P.S. Case no. 39 of 2016.
