This application is for grant of regular bail in connection with Tirbeniganj P.S.Case No.290 of 2017for the offences under Sections 302 of the Indian Penal Code. Allegation against the petitioner is of stabbing the deceased causing severe injury to him and he died. Submission of the learned counsel for the petitioner is that there is land dispute and nobody had seen the occurrence. He is in custody for more than one year.

Heard learned A.P.P. also, who has opposed the prayer for bail stating that the petitioner is main accused and he was seen with the dagger just after the occurrence and the deceased died due to the same.

No.48340 of 2018 (4) dt.31-10-2018 2/2 Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner at this stage, however, as he is in custody for more than one year, in such view of the matter, the learned trial court is directed to expedite the commitment and if the commitment has already been made, the learned trial court shall expedite the trial and try to conclude it as soon as possible.

With the aforesaid observation, this application is dismissed.
