The petitioner seeks bail in Hulasganj P.S. Case No. 148/2018, instituted for offence under Section(s) 25(1-b)a, 26 and 35 of Arms Act.
Learned counsel for the petitioner has submitted that there is admitted land dispute between the family of petitioner and his Pattidars. Petitioner is informant in Hulasganj P.S. Case No. 36/2014 and Hulasganj P.S. Case No. 61/2014. Due to such dispute petitioner and his family members have been implicated in this case. There is no allegation of specific overt act against this petitioner in the written report.
The other co-accused persons have already been granted bail by a Co-ordinate Bench of this Court vide order
Patna High Court CR. MISC. No.38851 of 2019(2) dt.01-07-2019 2/2 dated 02.04.2019 passed in Cr. Misc. No. 20063/2019. Petitioner is in custody since 06.05.2019.
Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Jehanabad, in connection with Hulasganj P.S. Case No. 148/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
