The petitioner, who is in custody, seeks bail in connection with S.Tr. No. 251 of 2018 arising out of Semra P.S. Case No. 166 of 2017 registered for the offence punishable under Sections 302, 304(B), 201/34 of the Indian Penal Code. Informant has alleged in the written complaint that he had adopted Renu Devi from her childhood and her marriage was solemnized with Sanjay Pandit (petitioner) and one daughter and one son was also born from the said wedlock, but after marriage she was being assaulted for non-fulfillment of demand of dowry. On 12.12.2017 he came to know that Renu Devi is missing from the night. On such information, he went to the house of Renu Devi and came to know that petitioner alongwith other co-accused persons killed Renu Devi

Patna High Court Cr.Misc. No.44192 of 2018(4) dt.27-09-2018 2/2 in the night and kept the dead body on the Railway track for concealing evidence.

It has been submitted on behalf of the petitioner that petitioner is the husband of deceased and he has been falsely implicated in this case. It has been further submitted that there is no eye witness of the occurrence and it is an accidental or suicidal case. It has been further submitted that doctor did not find any sign of cruelty over the body rather opined that heavy crush over the neck which is the sign of the cut of neck by the rail wheel. It has been further submitted that there is general and omnibus allegation against petitioner. Petitioner has no criminal antecedent and he is in custody since 13.12.2017. Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned IInd Additional Sessions Judge, Bagaha, West Champaran, in connection with S.Tr. No. 251 of 2018 arising out of Semra P.S. Case No. 166 of 2017.
