Petitioner apprehends arrest in a case registered for the offence punishable under Sections 302/34 of the IPC and 27 of Arms Act.

As per the prosecution case, this petitioner along with two other co-accused persons shot dead the son of the informant.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. The informant is not an eye witness of the occurrence and only on suspicion the petitioner has been made accused in this case. During investigation there is no direct or indirect material which show the complicity of the petitioner in the

Patna High Court CR. MISC. No.43496 of 2022(2) dt.01-12-2022 2/2 aforesaid case. It is further submitted that the petitioner is an unmarried girl and has got clean antecedent.

Learned counsel appearing for the State opposes the prayer for bail.

Considering the facts of the case, in the event of arrest/surrender within six weeks from today, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ACJM-1, Aurangabad in connection with Nabinagar P.S. Case No. 92/2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
