Learned counsel for the petitioners submits that the petitioner no.2, Muklesh Bind has already been arrested so application for anticipatory bail filed by him has become infructuous.

Accordingly, it is dismissed as infructuous.

Petitioners apprehend their arrest in connection with a case registered under Sections 341, 323, 325, 307, 379, 504 and Section 34 of the Indian Penal Code.

Allegation in brief is that all accused persons quarreled and assaulted with lathi and danda entering inside the

Learned counsel for the petitioners submits that there is case and counter case between both sides besides this land dispute also exists and the petitioners have no criminal antecedent. However, the injury of two persons are found grievous as reflected from the impugned order, so the prayer for anticipatory bail of petitioner nos.1, 3 and 4, namely, Jitendra Bind, Bhikhari Bind and Binod Bind is rejected. However, if they surrender and seek regular bail, the same shall be considered on its own merit without being prejudiced by this order. (Arun Kumar, J) N.H./- U T
