JUSTICE RAKESH KUMAR ORAL ORDER 04-10-2016 Heard Sri Ajay Thakur, learned counsel, who was assisted by Sri Amit Kumar, learned counsel for the petitioner and Sri Ram Naresh Ray, learned Addl. Public Prosecutor. The sole petitioner, who is in custody since 24.07.2016 in Araria P.S. Case No.472/2016 registered for the offence under Sections 420/ 482/ 488/ 120(B)/34 of the Indian Penal Code and 104 of the Trade Mark Act,1999, has prayed for grant of bail.

It was submitted by learned counsel for the petitioner that the petitioner is having clean antecedent and he was having licence to run business of cement. However, on false accusation, the petitioner has been made accused and was apprehended.

Learned Addl. Public Prosecutor, opposing the

Patna High Court Cr.Misc. No.40629 of 2016 (2) dt.04-10-2016 2/2 prayer for bail of the petitioner submits that from the godown of the petitioner, huge quantity of adulterated cement was recovered. Keeping in view the nature of accusation, clean antecedent of the petitioner, as mentioned in paragraph-3 of the petition, and period of custody, let the petitioner, namely, Manoj Kumar Paswan @ Manoj Paswan be enlarged on bail on furnishing bail bond of Rs.10,000/-( ten thousand ) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Araria in connection with Araria P.S. Case No.472 of 2016.
