The petitioner is apprehending arrest in a case registered for the offences punishable under Section 395 of the Indian Penal Code.

On commission of dacoity, in the house of the informant, the FIR was registered against 5-6 unknown. The name of the petitioner sprang up during investigation on the confession of co-accused Mukhtar Alam.

It is submitted by learned counsel for the petitioner that there is no recovery from the petitioner. Moreover, a statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts may constitute good ground for

Patna High Court Cr.Misc. No.33105 of 2015 (2) dt.12-08-2015 2/2 consideration of prayer for regular bail.

Let the learned Court below consider the prayer for regular bail of the petitioner, if the petitioner surrenders within a period of six weeks in connection with Bhadurganj P.S. Case No.43 of 2014, pending before the learned Chief Judicial Magistrate, Kishanganj.

With the above observation, this application is, accordingly, disposed off.
