JUSTICE ARVIND SRIVASTAVA ORAL ORDER 28-06-2017 Heard learned counsel for the petitioner and learned A.P.P. for the State.

Petitioner is in custody since 25.11.2016 in connection with Charpokhari P.S. Case No. 0013 of 1998 registered under Sections 147, 148, 149, 307, 341 of the Indian Penal Code. Learned counsel for the petitioner has submitted that the petitioner, who is of clean antecedent, is innocent and has not committed any offence. In fact, the petitioner has been granted regular bail by lower court but due to mistake on the part of the Pairvikar of the petitioner, bail bond of the petitioner has been cancelled. Moreover, charges have been framed in this case, which is evident from supplementary affidavit filed on behalf of the petitioner. The petitioner is rotting in custody for the last seven months. Considering the facts and circumstances of the case, let

Patna High Court Cr.Misc. No.17389 of 2017 (3) dt.28-06-2017 the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand rupees only) with two sureties of the like amount each to the satisfaction of the learned 4th A.D.J., Bhojpur at Ara in connection with Charpokhari P.S. Case No. 0013 of 1998/S. Tr. No. 320 of 1998.
