2. The petitioner has preferred this application for grant of regular bail in connection with Excise P.S. Case No. 2861 of 2026 dated 06.05.2026 registered for the offences punishable under Sections 30(a), 41 and 56(b) of the Bihar Prohibition and Excise Act.

3. As per the allegation, total 48 liters of illicit foreign liquor was recovered from a Swift Dezire car, which the petitioner was found driving and from other vehicle 190.080 litres of illicit foreign liquor was recovered.

4. Learned counsel for the petitioner submits that petitioner is innocent and has been falsely implicated in this case. It has further been submitted that nothing has been recovered from the conscious possession of the petitioner. It has

It has further been submitted that petitioner being the driver was not aware that the consignment contained the illicit liquor. It has further been submitted that the procedures of search and seizure as prescribed under Section 103/105 of the B.N.S.S. have not been followed with. It is further submitted that the petitioner has got no criminal antecedent. It has lastly been submitted that petitioner is in custody since 07.05.2026.

5. Learned A.P.P. for the State has vehemently opposed the prayer for bail of the petitioner.

6. Heard the parties and perused the records.

7. Considering the facts and circumstances of the case as well as the period of custody, the petitioner above-named is directed to be enlarged on bail on furnishing bail-bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Excise P.S. Case No. 2861 of 2026.

8. The application stands allowed.
