JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 07-07-2017 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Hasanpur P.S. Case No. 11 of 2017, registered for the offences punishable under Section 379/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that allegation is that while the informant was going alongwith one of his family members on a motorcycle after withdrawing a sum of Rs. 24,000/- from his State Bank of India, account, this petitioner intercepted him and took away the bag containing the said amount. Thrust of the argument on behalf of the petitioner is that though there is an allegation of snatching the bag but there is no

Patna High Court Cr.Misc. No.28497 of 2017 (2) dt.07-07-2017 recovery from the possession of this petitioner. Learned counsel further submits that the petitioner has no criminal antecedent and he is in jail custody since 8.2.2017.

Heard, learned A.P.P. for the State opposes the prayer for bail.

Considering the facts and circumstances of the case particularly that there is no recovery from the possession of this petitioner and the petitioner has got clean antecedent, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten thousand only) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 3rd, Samastipur, in connection with Hasanpur P.S. Case No. 11 of 2017, subject to condition, as laid down under Section 437(3) of the Cr.P.C. (Rajeev Ranjan Prasad, J) siddharth/- U T
