JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 07-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 290, 419, 420, 34 of the Indian Penal Code and Section 47(A) of Excise Act.
Petitioner is in jail custody since 24.05.2016 and earlier his prayer for bail was rejected by this court directing the trial court to proceed with the trial and conclude the same as early as possible, preferably within three months.
However, subsequently, the aforesaid period was extended for six months on the prayer of court below.
The learned court below has reported that charge against the petitioner was framed on 02.09.2016 and process has
Patna High Court Cr.Misc. No.48671 of 2016 (3) dt.07-12-2016 2/2 already been issued against the prosecution witnesses but up till now, not a single prosecution witness could be examined. Considering the aforesaid facts and circumstances as well as period of detention of the petitioner in jail custody and also taking note of this fact that petitioner does not have any criminal antecedent, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Sri Ramesh Kumar, Judicial Magistrate 1st Class, Gaya in connection with Chandauti P.S. Case No. 303 of 2012.
