ANJANA MISHRA ORAL ORDER 19-08-2015 Heard learned counsel for the petitioners and learned Additional Public Prosecutor for the State.
The petitioners apprehend their arrest in connection with a case registered for the offences punishable under Sections 147,148,149,323,504,379,307 of the Indian Penal Code. Learned counsel for the petitioners submits that the dispute in question arose on account of some altercation having been taken place while they were taking bath at village temple. He submits that there is no such type of occurrence. He further submits that with regard to the same occurrence, the petitioners have also filed a case before the Police being Bhabhua P.S. Case No. 284 of 2015.
Considering the nature of allegations made against the
Patna High Court Cr.Misc. No.32931 of 2015 (3) dt.19-08-2015 P2/2 petitioners and also the fact that there is case and counter between the parties, let the petitioners above named, in the event of their arrest / surrender within a period of three weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) each with two sureties of the each amount to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabhua in connection with Bhahua P.S. Case No. 283 of 2015 subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
