JUSTICE BIRENDRA KUMAR ORAL ORDER 13-01-2017 Heard learned counsel for the petitioner and learned APP for the State.

Petitioner is languishing in custody in connection with Abramabad Town P.S. Case No. 234 of 2016 for the offences punishable under Sections 25(1-b)/26 of the Arms Act. From the possession of this petitioner a country made loaded pistol was recovered. The petitioner is in custody since 02.08.2016. The petitioner has stated on oath that he has got no criminal antecedent. However, in subsequent case the petitioner has been roped.

Considering the nature of offence, I am not inclined to enlarge the petitioner on bail. The bail prayer of the petitioner is refused. However, the petitioner may renew his bail prayer after completion of nine months of the custody before the Court below
