The petitioner seeks bail in Sanhoula P.S. Case No. 71/2018, which was initially instituted for offence under Section(s) 366(A)/34 of the Indian Penal Code. Later on Sections 363, 376 and 327 of the Indian Penal Code read with Section 4 of POCSO Act were also added.

Learned counsel for the petitioner has submitted that there is no any specific allegation against this petitioner in the F.I.R. as well as in the statement of victim recorded under Section 164 Cr.P.C. (Annexure-2). Victim has levelled specific allegation against Pappu Singh in her statement, who had performed marriage with her and had established physical relation with her. In the Statement recorded under Section 164

Patna High Court CR. MISC. No.38439 of 2019(2) dt.27-06-2019 2/2 Cr.P.C., victim has stated that this petitioner had washed out her Mang and had given threat of dire consequences. Petitioner is in custody since 29.04.2019.

Considering the aforesaid facts and circumstances, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Addl. District & Sessions Judge 1st-cum-Special Judge, POCSO Act, Bhagalpur, in connection with Sanhoula P.S. Case No. 71/2018, subject to the conditions that both the bailors shall be the close relative of the petitioner.
