JUSTICE DINESH KUMAR SINGH ORAL ORDER 03-09-2015 Heard learned counsels for the petitioners and the State.

The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 307, 120B/34 of the Indian Penal Code.

The prosecution case is that the informant being electrician was hired by the petitioners being Operator and Junior Electrical Engineer of Power Distribution Company and while repairing electric defect, on the order of the petitioners, the informant received electric shock since inspite of assurance being given by these petitioners the electric supple was not disconnected.

It is submitted by learned counsel for the petitioners

Patna High Court Cr.Misc. No.34971 of 2015 (2) dt.03-09-2015 2/2 that there is nothing on record to suggest that the informant was hired by the petitioners. In fact, the informant is a private electric mechanic and for his own gains while repairing the electric supply line he might have received electric shock. It is further submitted that for the occurrence of 30.09.2013, the FIR was lodged on 29.11.2013. Moreover, a statement has been made in paragraph 3 of the petition that the petitioners have no criminal antecedent.

Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Saran at Chapra in connection with Mohhamadpur P.S. Case No.146 of 2013, subject to the conditions as laid down under Section 438(2) Cr.P.C.
