Petitioner seeks bail in a case registered under section 302/34 of the Indian Penal Code and 27 of the Arms Act. Petitioner is said to have shot fire on the deceased and submission on behalf of the petitioner is that there is delay of one and half hour in lodging the first information report and the aforesaid fact goes to show that at the time of alleged occurrence, no one was present but I am not at all convinced with the aforesaid submission. Considering the nature of the allegation levelled against the petitioner as well as facts and circumstances of the case, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sasaram (Agrer) P.S. Case no. 169/2016 pending in the court of the Chief Judicial Magistrate, Rohtas at Sasaram stands rejected.
