JUSTICE RAVI RANJAN ORAL ORDER 13-07-2017 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 341, 323, 307, 353, 272, 273/34 of the Indian Penal Code and Sections 41, 30 (a) of Bihar Liquor Prohibition and Excise Act, 2016.
It is contended that, as per allegation, 72 liters of Nepali liquor was recovered. The allegation of assault is not established upon the petitioner. The person, who was apprehended, had disclosed the name of the petitioner. It is further contended that the co-accused Pawan Das has already been granted bail by a coordinate Bench of this Court vide order dated 1.07.2017 passed in Cr. Misc. No.29443 of 2017. It is urged that the petitioner is in custody since 26.02.2017 and
Patna High Court Cr.Misc. No.31761 of 2017 (2) dt.13-07-2017 2/2 his antecedent is clean.
Considering the facts and circumstances of the case, the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Sitamarhi in connection with Bairagania P.S. Case No. 45 of 2017 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
