JUSTICE BIRENDRA KUMAR ORAL ORDER 13-01-2017 Heard the learned counsel for the petitioner, the complainant (opposite party no. 2) and the State. This is a petition for grant of regular bail for offence under Sections 323, 379 and 498A of the Indian Penal Code. The petitioner is the husband of opposite party no. 2, Rani Kumari.
With the consent of the parties, let the matter be sent for re-conciliation.
In the meantime, the petitioner, above named, be released on provisional bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each in connection with Complaint Case No. 59 of 2016/ Trial No. 3076 of 2016 to the satisfaction of the Chief Judicial Magistrate, Gaya, or successor Court.
Reconciliation shall be conducted before the Committee available in the concerned district and on failure of reconciliation the Court below shall consider the
Patna High Court Cr.Misc. No.54595 of 2016 (2) dt.13-01-2017 confirmation/rejection of provisional bail taking into consideration as to who is responsible for non-cooperation and non-settlement of dispute.
