The petitioner seeks regular bail in connection with S.T. No. 91 of 2018 arising out of Morkahi P.S. Case No. 158 of 2017, G.R. NO. 2995 of 2017 registered for offences punishable under Sections 353, 384, 307 of the Indian Penal Code as well as Section 25(1-b)(a)/26/35/27 of the Arms Act.

Allegation against the petitioner is that police went to intercept an accused. There was firing from two sides and 7 persons were arrested and there was some recovery from other accused persons. Although there is no recovery from the possession of the petitioner.

Submission of learned counsel for the petitioner is that though petitioner is in accused in ten other cases and he is on bail in all those cases and he is in custody since 14.12.2017.

Misc. No.8869 of 2018 and order dated 19.04.2018 passed in Cr. Misc. No.21914 of 2018 by coordinate Bench of this Court.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/-(Twenty Five thousand) with two sureties of the like amount each to the satisfaction of the learned Court of District Judge, Khagaria in connection with S.T. No. 91 of 2018 arising out of Morkahi P.S. Case No. 158 of 2017, G.R. No. 2995 of 2017, subject to condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court.
