2. The petitioner has preferred this application for grant of regular bail in connection with Nemdarganj P.S. Case No. 364/2024 dated 21.11.2024 registered for the offences punishable u/ss 190, 191(2), 126(2), 115(2), 117(2), 109, 324(4) of the BNS and later on added section 103(1) of the BNS.

3. As per the prosecution case, the petitioner and the co-accused persons armed with various weapons are alleged to have come and started abusing the informant's husband. On the exhortation of the co-accused, Mukesh Yadav, all the accused persons started assaulting the informant's husband, in the meantime, the petitioner, Munni Yadav assaulted the informant's

When the informant went to rescue, the co-accused Nikku Kumar, Vikash Yadav, Sujeet Kumar and Pintu Kumar also assaulted her and Tara Devi broke her finger and assaulted on her head and the co-accused Pintu Kumar also broke her mobile phone and all the accused persons broke the door and the window of her house.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. There is a land dispute between the parties. Nothing has been recovered from the conscious possession of the petitioner. It is further submitted that there is no allegation against the petitioner to have inflicted multiple blows on the head of the deceased. The charge-sheet has been submitted against the petitioner. The co-accused person has already been granted regular bail by this court vide order dated 25.06.2025 passed in Cr. Misc. No. 37912 of 2025. The petitioner has one criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 02.12.2024.

5. Learned A.P.P. for the State and learned counsel for the informant have vehemently opposed the bail petition of the petitioner by submitting that the specific allegation is against the

Patna High Court CR. MISC. No.43145 of 2025(6) dt.15-10-2025 3/3 petitioner who assaulted the informant's husband with khanti causing injury on his head and during the course of treatment, he died. The post-mortem report of the deceased also supported the prosecution case. As per the post-mortem report of the deceased, the cause of death is craniocerebral damage and its complication caused by hard blunt object. The allegation of assaulting against the petitioner is also evident from para nos. 3, 7 and 8 of the case diary.

6. Considering the aforesaid facts and circumstances of the case as well as the specific and heinous nature of allegation against the petitioner, I am not inclined to enlarge the petitioner above-named on bail.

7. Learned trial court is directed to expedite the trial and conclude the same at the earliest.
