The petitioner seeks regular bail in connection with Gaya Mufasil PS case no. 387 of 2015 registered for the offences punishable under Sections 353, 307 and other sections of Indian Penal Code and Section 27 of Arms Act. The accusation is with regard to altercation between the accused persons and the staffs of the informant on account of certain construction of the road and when the police tried to pacify the situation, the accused persons are said to be obstructed them in discharge of their official duty. Learned counsel for the petitioner submits that there is no specific allegation of any overt act against the petitioner, similarly situated co-accused persons have already been granted bail by this Hon'ble Court vide order dated 15.12.2015

Patna High Court Cr.Misc. No.30726 of 2017 (2) dt.06-07-2017 2/2 and 30.03.2016 passed in Cr. Misc. no. 56247 of 2015 and Cr. Misc. no. 13728 of 2016 respectively, the petitioner has no criminal antecedent and he is in custody since 26.03.2017. Having regard to the facts and circumstances of the case, I deem it fit and appropriate to enlarge the petitioner on regular bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Gaya Mufasil PS case no. 387 of 2015.

As the counsel for the petitioner submits that the mother of the petitioner has died yesterday, it is directed that the Fax be sent today itself upon deposit of requisites by the counsel for the petitioner.
