Heard learned counsel for the petitioner, learned A.P.P. for the State along with learned counsel appearing on behalf of OP No. 2.

The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 307, 498A, 406, 323, and 379 of the Indian Penal Code and Sections 3 and 4 of the Dowry Prohibition Act.

The learned counsels for the parties submit that the case was referred for mediation and the dispute in between the parties has been resolved amicably as would manifest from the Memorandum of Agreement entered in between the petitioner and the OP No. 2, signed by their respective learned lawyers. 4.

Learned counsel appearing on behalf of the OP No.

Patna High Court CR. MISC. No.41245 of 2023(6) dt.29-03-2024 2/2 2 submits that for the present, he is not opposing the anticipatory bail application of the petitioner, since the petitioner has accepted to honour the Memorandum of Agreement entered in between him and OP No. 2. 5.

Considering the submissions made by the learned counsel for the petitioner, the petitioner above-named, in the event of his arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with C.R. No. 114 of 2021, subject to the conditions as laid down under Section 438

(2) of the Cr.P.C.

However, OP No. 2 shall be at liberty to file an application seeking cancellation of the anticipatory bail granted to the petitioner in the event if the petitioner does not honour the Memorandum of Agreement dated 9-2-2024 entered in between the petitioner and the OP No. 2.
