This application is for grant of regular bail in connection with Murliganj P.S.Case No.101 of 2017, for the offences punishable under Sections 379 and 411/34 of the Indian Penal Code.

Allegation against the petitioner is that while committing theft, 'hulla' was raised and thereafter, the petitioner was arrested on chase along with the other accused persons and one loaded country-made pistol and some cartridges were also recovered.

Submission of the learned counsel for the petitioner is that he has been falsely implicated in this case and no stolen articles have been recovered. The petitioner has clean antecedent and he is in custody for more than three months.

Having heard both sides and in view of the fact that he was arrested just after the occurrence, as such I am not inclined to grant bail to the petitioner at this stage, , however, the learned trial court is directed to expedite the trial and try to conclude it within a period of four months and if not concluded, the petitioner is at liberty to renew his prayer for bail bond before the court concerned.

With the aforesaid observation, this application is dismissed.
