In this case, the petitioner is seeking anticipatory bail in connection with Pachrukhi P.S. Case No. 365 of 2018, registered for the offence under Sections 414, 419, 420, 467, 468, 471 and 120(B) of the Indian Penal Code. The Police, on secret information, has intercepted a group of persons and arrested one person, who has disclosed his name as Chitranjan Mishra and also disclosed the activity of the gang in what manner they were cheating innocent people. The Police has investigated the case and every witness has taken the name of the present petitioner.

Learned counsel for the petitioner submits that coaccused, Chitranjan Mishra, has been granted regular bail by the

Patna High Court CR. MISC. No.39221 of 2019(3) dt.26-07-2019 2/2 Court below.

Looking to the nature of allegation, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail is rejected. However, if the petitioner surrenders before the Court below within three weeks from today and prays for regular bail, the Court below will consider the same and pass appropriate order without being influenced by the order of this Court considering the fact that co-accused, Chitranjan Mishra has been granted regular bail.
