This application is for grant of regular bail in connection with Katihar (Town) P.s.Cae no.974 of 2017 for the offences under Sections 307, 302, 34 of the Indian Penal Code. Allegation against the petitioner is of assault by Gupti to the deceased and due to which he died. Submission of the learned counsel for the petitioner is that there is no witness of the occurrence and in the dead of the night it is not expected that any witness will be there and on hulla the informant came there. Furthermore, he is in custody since 3.1.2018.

Heard learned A.P.P. also, who has opposed the prayer for bail stating that there is allegation against the petitioner

Patna High Court Cr.Misc. No.47252 of 2018 (3) dt.20-09-2018 2/2 of stabbing and two inside wounds were found in the abdomen. Having heard both sides and in view of the facts and circumstances, as stated above, I am not inclined to grant bail to the petitioner. .

With the aforesaid observation, this application is dismissed.
