JUSTICE PURNENDU SINGH ORAL ORDER 15-10-2025 Heard Mr. Santosh Kumar Singh, learned counsel appearing on behalf of the petitioner; Mr. Dhiraj Sagar, learned counsel for the O.P. No. 2 and Mr. Nand Kishore Prasad, learned APP for the State.
2. The petitioner seeks pre-arrest bail in connection with Mahila P.S. Case No. 01 of 2025, registered for the offence punishable under Sections 354(B), 379, 506, 34 of the Indian Penal Code and Section 67 of the I.T. Act.
3. As per the allegation made in the FIR, the petitioner
Patna High Court CR. MISC. No.41577 of 2025(3) dt.15-10-2025 2/3 had committed wrong with the informant.
4. Learned counsel appearing on behalf of the petitioner and learned counsel for the opposite party no. 2 jointly informed this Court that the parties have settled their dispute by performing marriage with each other and are living together happily, therefore, in light of the law laid down by the Apex Court in the case of Naushey Ali vs. State of U.P. reported in (2025) 4 SCC 78 further proceeding will only be vexatious.

Considering the aforesaid information given on behalf of the parties, as well as, the law laid down by the Apex Court, without going into the merits of the case, the petitioner, above named, is directed to be released on pre-arrest bail, in the event of his/her arrest or surrender before the learned District Court within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned District Court where the case is pending, in connection with Mahila P.S. Case No. 01 of 2025, subject to the condition as laid down under Section 482(2) of the BNSS.
8. The learned District Court is directed to verify the criminal antecedent of the petitioner as stated in paragraph no. 3 of the bail application. If any other case is pending against the petitioner as what has been stated in
Patna High Court CR. MISC. No.41577 of 2025(3) dt.15-10-2025 3/3 paragraph no. 3, this order will lose its force automatically. (Purnendu Singh, J) Niraj/- U T
