The petitioner seeks regular bail in connection with Itarhi Case No. 240 of 2017 (S.T. No. 142 of 2018) registered for offences punishable under Section 302/34 of the Indian Penal Code.

Allegation against the petitioner is that he made firing on the deceased causing his death.

Submission of the learned counsel for the petitioner is that there is eye witness of the occurrence and he has falsely been implicated in this case and other co-accused Ranjan and Rajendra Singh have already been granted bail by coordinate Bench of this Court vide order dated 19.04.2018 passed in Cr. Misc. No. 21951 of 2018 and order dated22.05.2018 passed in Cr. Misc. No.30415

Patna High Court Cr.Misc. No.45537 of 2018 (3) dt.10-09-2018 2/2 of 2018. Petitioner is languishing in custody since 18.12.2017. Heard learned A.P.P. also.

Having heard both sides and from perusal of the record that it appears that there is direct allegation against him of firing causing death.

In view of the facts and circumstances, as stated above, I am not inclined to grant privilege of bail to the petitioner. The trial Court is directed to expedite the trial.
