JUSTICE DINESH KUMAR SINGH ORAL ORDER 10-08-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 353 and 504 of the Indian Penal Code.
The prosecution case is that the informant being the DCLR, on the orders of superior officer, went to the house of the petitioner to make an enquiry regarding the cause of death of uncle of the petitioner then he was slapped, abused by the petitioner and thereby the petitioner obstructed the informant in performing the official duty.
It is submitted by learned counsel for the petitioner that uncle of the petitioner committed suicide on 15.05.2015 due to non-payment of the price of paddy supplied and the inaction of the authority were protested by the villagers when the informant
Patna High Court Cr.Misc. No.32478 of 2015 (2) dt.10-08-2015 2/2 lodged the present FIR on 16.05.2015 in order to save his own skin. A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent.
Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Gaya in connection with Khizersarai P.S. Case No.122 of 2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
